Cargo damage notice to the carrier email template (English)
Tell the carrier in writing about damage or shortage found at delivery, hold it responsible and ask for a joint survey, within the notice period. The emails are in English, the usual language of international trade. Nothing you type is sent to Triplicate.
Tips for this email
- Send the notice in writing at once. Under the Hague-Visby Rules (article III rule 6) and US COGSA, notice is due when the goods are taken over or, if the damage is not apparent, within 3 days; without it, the goods are presumed delivered as described in the bill of lading. For air cargo, the Montreal Convention (article 31) requires a written complaint within 14 days of receipt, and without one no action lies against the carrier.
- Do not sign a clean delivery receipt if damage or shortage is visible: write it on the receipt or the equipment interchange receipt. Keep the damaged goods and the packaging, take photos, ask for a joint survey and tell your cargo insurer straight away.
- Mind the time limit for going to court: one year from delivery under the Hague-Visby Rules and US COGSA (Hague-Visby allows a longer period if both sides agree after the cause of action has arisen), two years under the Montreal Convention. If talks take long, ask the carrier in writing to extend the time.
